We take this opportunity to inform you that Argentinian Trademark Office has recently issued the new Resolution 295\/2024<\/u><\/strong>. Given the above, please find below the summarized information regarding the changes in procedure:<\/p>\n\n\n\n

– The main change is that that there will be a new official fee for the applicant in the Administrative Opposition Resolution Procedure and in case that the applicant does not pay that fee the trademark application will be consider as abandon.<\/p>\n\n\n\n

– This new fee will apply once the opponent of a trademark application ratifies the opposition, and it is time for the applicant to decide if they wish or not to file a defense for their trademark.<\/p>\n\n\n\n

– If the applicant wants to keep it trademark alive, they will have to pay this fee regardless of whether they decide to file a writing before the Trademark Office to defend their trademark from the opposition.<\/p>\n\n\n\n

– The period to pay the fee will be 15 \u2013 fifteen \u2013 working days<\/u><\/strong> since the applicant is notified by the TMO.<\/p>\n\n\n\n

– The Resolution will apply not only from now on but retroactively to the trademarks that are still within the Opposition Procedure and where the ratifications made by the opponent have not been replied in order for them to decide if they want to pay for keeping their application alive or not. For the above mentioned the Trademark Office will notify weekly in the Trademark Bulletin a list of applicants of this past oppositions with ratifications not replied so that they are able to proceed with the payment of the Official Fees or not.<\/p>\n\n\n\n

– This Official Fee will be paid only once per application no matter the number of opponents.<\/p>\n\n\n\n

– The relevant impact for the client is that in all the opposition cases that are still open \u2013 or in future oppositions \u2013 and that are already paid the ratification fees, the counterparty will have to decide if they wish to pay this fee and keep their trademark or to abandon it. Given the above, some part of the pending oppositions will be sorted out if the applicants choose not to pay the new fee.<\/p>\n\n\n\n

– On the other hand, in case that an opposition is made to one of the client\u2019s trademarks and we arrive to the stage where it is ratified they will have to decide not only if they wish to file of not a defense but if they want to pay the Official Fee and keep the trademark alive or not paying it and let the trademark be consider as abandon.<\/p>\n\n\n\n

Furthermore, we consider that this new fee and procedure will significantly expedite the Administrative Opposition Resolution Procedure in the numerous cases in which the applicant does not file a writing defending and arguing its position.<\/p>\n\n\n\n
