The Chamber of Deputies recently approved Argentina\u2019s accession by 147 votes in favour and 93 against.<\/p>\n<p style=\"text-align: justify;\">Nevertheless, it is important to note that the approval covers the basic PCT framework: the filing of a single international application, an international search, publication, and subsequent entry into the national phases. The Argentinian Trademark Office (INPI) retains the authority to grant or refuse each patent according with the Argentine legislation.<\/p>\n<p style=\"text-align: justify;\">Furthermore, the Chamber of Deputies approved accession subject to a reservation regarding <strong>Chapter II<\/strong>, rather than a complete accession to the Treaty. This reservation excludes Argentina from the optional international preliminary examination procedure, while retaining the mandatory international search under Chapter I.<\/p>\n<p style=\"text-align: justify;\">In other words, the Chamber of Deputies rejected both the proposal for complete accession and the proposal to reject accession to the PCT altogether.<\/p>\n<p style=\"text-align: justify;\">Although the proposed bill is progressing favourably, <strong>it has not yet been enacted into law<\/strong>. It has been referred to the Senate, which now will either accept the amendments introduced by the Chamber of Deputies or insist on its original text.
