It has come to our attention that as of May 1st, 2025, there is a significant delay when obtaining the Apostille for documents that require it (particularly, Powers of Attorney) in France. As of the above-mentioned date, the Apostille is no longer obtained before the Courts of Appeal; it is instead obtained from the Center of Legalization and Apostille of Paris (CLAP) before Notaries, which causes delays that are difficult to estimate. We would like to inform you that this apparently prolonged delay may be solved in Argentina in the following way:
For the filing of Trademarks, Designs and Patents, the Power of Attorney may be filed within 40 (forty) business days from the date of filing the Trademark, Design or Patent. If this document is not available due to the lack of seal of the Apostille at that time, a signed and notarized copy sent via e-mail may be filed before the Office while awaiting receipt of the original document duly apostilled at a later date.
Following several queries from our French colleagues regarding this issue during the past few days, we consulted with officials from the Office and agreed on the above-mentioned solution.
